I represented a client in District Court who was charged with Assault and Battery on a Household Member and Possession of a Firearm Without an FID Card. The Assault and Battery charge was dismissed. The Assistant District Attorney prosecuting the case sought 1 year of supervised probation with random screens for drugs and alcohol. Alcohol was a contributing factor in the incident on which the charges were based. My client was an executive with a firm that did business with the Department of Defense. He visited military installations frequently as part of his employment. He requested a shorter term of probation with no random screens for alcohol and drugs. I was able to convince the Judge to continue the matter without a finding of guilt to be dismissed within three (3) months. The probation period of three (3) months was ordered to be unsupervised and no urine screens were ordered.
