I represented a client in the Worcester District Court on charges of Assault and Battery on a Household Member and Threatening to Commit a Crime. My client allegedly grabbed and bruised his partner’s arm while he was driving an automobile and threatened to kill him. My client was found not guilty on both charges after a jury trial. The alleged victim testified that he was thrown out of the vehicle and was abandoned at the scene. A photograph of his bruised arm was presented to the jury. On cross examination, it was determined that the victim took the photograph himself while at the police station. Further, the victim claimed he was forced to exit the moving vehicle he was operating. The victim claimed he was wearing shorts and sandals but received no injury from exiting the vehicle. Further, he claimed that my client was simultaneously able to jump from the rear seat to the driver’s seat and take control of the vehicle. The jury took ten minutes to deliberate and reach its verdict.
