Case Summary: Attorney Franklin represented husband in a 10 year marriage.  It was husband’s first marriage and wife’s second.  Wife brought two children into the household from the first marriage.  No children were born from the marriage.

Wife earned an average of approximately $121,000.00 per year.  Husband earned and average of approximately $149,000.00 per year.  Wife’s earnings dropped to $70,000.00 annually in the last two years of the marriage due to poor economic conditions and wife’s mental health.  Husband owned the marital home in Worcester County prior to the marriage.  The equity in the marital home was approximately $155,000.00.  In addition, the parties jointly purchased real estate in New York.  Equity in this real estate was approximately $207,000.00.

Husband had approximately $348,000.00 in bank accounts and retirement assets.  Wife had approximately $152,000.00 in bank accounts and retirement assets.

Wife sought alimony in the amount of $1,500.00 per week and a one half of the marital estate.  Husband did not want to pay alimony and he wanted to keep the marital home and his retirement assets.

Results: After trial in Worcester Family Court, the Judge ordered Husband to pay alimony in the amount of $300.00 per week.  Husband was awarded the marital home and the parties were ordered to sell the real estate in New York.  Wife received all proceeds from the sale.  Each party was allowed to keep their retirement accounts, bank accounts and personal property.  Husband was ordered to pay wife $10,000.00 to equalize the property division between them.
